Terms of Service

1. Eligibility

You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you are 17 or older. If we discover that a user is under 17, we will terminate their account immediately.

You may not use the App if you are prohibited from doing so under applicable law.

2. Accounts

2.1 Registration

The App uses Google Sign-In and Apple Sign-In for authentication. By signing in, you authorize us to access the basic profile information provided by those services (name and email address) in accordance with our Privacy Policy.

2.2 Account Responsibility

You are solely responsible for all activity that occurs under your account. You must:

• Keep your login credentials secure and not share them with others
• Notify us immediately if you suspect unauthorized access to your account
• Not allow any other person to access the App through your account

If someone else accesses your account — whether due to your negligence, credential sharing, phishing, or any other reason — you bear full responsibility for any resulting actions, including purchases made or conduct violations committed. We are not liable for any loss or damage arising from unauthorized account access.

2.3 Account Termination

We reserve the right to suspend or permanently terminate your account at any time, for any reason, including but not limited to violations of these Terms. Upon termination:

• Your license to use the App is immediately revoked
• All virtual items, currency, and progress are forfeited
• We reserve the right — but are not obligated — to issue partial refunds at our sole discretion on a case-by-case basis
• You may not create a new account without our express written permission

3. Virtual Items and Currency

3.1 License, Not Ownership

When you acquire Virtual Content, you receive a limited, non-exclusive, non-transferable, revocable license to use that content within the App, subject to these Terms. This license may be revoked at any time at our sole discretion — including upon account termination, service discontinuation, or violation of these Terms — without any compensation, refund, or liability to you.

3.2 No Real-World Value

Virtual Content has no real-world monetary value and cannot be:

• Exchanged, redeemed, or cashed out for real money or prizes
• Transferred to another account
• Sold, traded, or gifted to other players
• Used outside of the App for any purpose

3.3 Modifications to Virtual Content

We reserve the right to modify, rebalance, remove, or discontinue any Virtual Content, game mechanic, feature, or in-game item at any time without notice and without any obligation to compensate you. This includes adjusting the relative power or availability of any chaos card, cosmetic item, or gameplay system.

4. Purchases

4.1 Payment Methods

In-app purchases (jewel packs and other virtual items) may be processed through:

• Apple App Store — governed by Apple's Terms and Conditions
• Google Play Store — governed by Google's Terms of Service
• Stripe — for web-based purchases

4.2 No Refunds

For purchases made through Apple or Google, their respective refund policies apply and supersede this section. Contact Apple or Google directly for refund requests on platform purchases.

4.3 Lifetime VIP Pass

The Lifetime VIP Pass is a one-time purchase, not a subscription. It grants ongoing benefits (including future theme unlocks and periodic jewel/chip credits) for as long as the App remains operational. These benefits are Virtual Content subject to the same license terms in Section 3.1 — they are licensed, not owned, and may be modified, suspended, or discontinued at any time, including upon service shutdown, without compensation or refund.

4.4 Taxes

You are responsible for any taxes applicable to your purchases. Prices displayed may or may not include applicable taxes depending on your jurisdiction.

5. User Conduct

5.1 Prohibited Behaviors

You agree not to:

• Use cheating software, hacks, exploits, bots, or any automated tools to gain an unfair advantage
• Harass, threaten, bully, or abuse other players
• Use hate speech, slurs, or discriminatory language based on race, ethnicity, gender, sexual orientation, religion, disability, or any other characteristic
• Choose a display name that is offensive, hateful, sexually explicit, or impersonates another person or entity
• Impersonate other players, Gold Dog Games employees, or any other person or entity
• Create a new account after being banned (ban evasion)
• Use automated scripts, scrapers, or crawlers to access or extract data from the App
• Attempt to gain unauthorized access to our servers, databases, or other systems
• Interfere with or disrupt the App or its servers
• Exploit bugs or glitches — if you discover one, report it to us instead
• Use the App to facilitate, organize, or participate in real-money wagering or gambling based on game outcomes, whether on or off the platform
• Use the App for any commercial purpose without our express written consent
• Violate any applicable law or regulation in connection with your use of the App

5.2 Catch-All

We reserve the right to take action against any behavior we determine, in our sole discretion, to be harmful to other players, the community, or the integrity of the App — even if not explicitly listed above.

5.3 Enforcement

Violations may result in warnings, temporary suspension, or permanent account termination at our sole discretion. All Virtual Content and progress associated with a terminated account is forfeited.

5.4 Automated Players (Bots)

The App may include automated computer-controlled players ("bots") in multiplayer game sessions. Bots may be assigned human-like display names, avatars, levels, and cosmetic items and will appear alongside human players at the table. We do not guarantee that any given seat in a multiplayer session is occupied by a human player. Bots are used to fill empty seats, maintain game availability, and ensure a consistent experience. We reserve the right to use bots in any game session at any time without notice. The proportion of bot players may decrease as the player base grows.

6. User Content

6.1 Content You Submit

By submitting content through the App — including your display name, quips, support messages, or any other text or information — you grant Gold Dog Games LLC a worldwide, royalty-free, perpetual, non-exclusive license to use, display, reproduce, and share that content for the purposes of operating, improving, and promoting the App.

This license does not transfer ownership of your content to us, and we will not sell your content to third parties. We may use your display name in screenshots, promotional materials, or social media posts featuring gameplay.

6.2 Content Standards

Any content you submit must comply with Section 5 (User Conduct). We reserve the right to remove any content and take action against any account that violates these standards.

7. Content Creation and Streaming

You are freely permitted to stream, record, and publish video or other content featuring Chaos Hold'em Poker on any platform (YouTube, Twitch, TikTok, etc.), including for monetized content. By doing so, you grant Gold Dog Games LLC a license to share, repost, and feature your content in our marketing and promotional materials.

Gold Dog Games LLC and its licensors retain all intellectual property rights in the underlying game, including its artwork, audio, code, and design. Your content creation rights do not transfer any ownership of game assets to you.

8. Intellectual Property

All content within the App — including but not limited to game code, artwork, card designs, theme assets, audio, music, logos, and the Chaos Hold'em Poker name — is proprietary to Gold Dog Games LLC or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership rights in the App or its content.

9. Service Availability

We do not guarantee that the App will be available at all times. The App may be:

• Taken offline for maintenance, updates, or technical issues
• Modified, suspended, or discontinued at any time, with or without notice
• Subject to outages or disruptions caused by third-party services (including Google Firebase, Apple, and Stripe) outside our control

We are not liable for any loss or inconvenience caused by service interruptions or the discontinuation of the App. In the event the App is permanently discontinued, all Virtual Content licenses expire and no refunds are owed, except as required by applicable law or platform refund policies.

10. Security

We implement reasonable security measures to protect your data and the integrity of the App. However, we are not liable for:

• Unauthorized access to our systems by third parties (hacking, cyberattacks, or data breaches)
• Security breaches affecting third-party services we use (including Google Firebase, Stripe, Apple, or Google)
• Loss, corruption, or unauthorized disclosure of data resulting from circumstances outside our reasonable control

You are responsible for the security of your own device and login credentials.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Gold Dog Games LLC disclaims all warranties including, without limitation:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the App will be uninterrupted, error-free, or secure
• Any warranty regarding the accuracy or reliability of any content within the App

12. Limitation of Liability

To the fullest extent permitted by applicable law, Gold Dog Games LLC and its owners, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, goodwill, or virtual items
• Damages resulting from unauthorized account access, service interruptions, or security breaches

13. Indemnification

You agree to indemnify, defend, and hold harmless Gold Dog Games LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the App
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any content you submit through the App

14. Force Majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, government actions, internet infrastructure failures, power outages, third-party service failures (including Google Firebase, Apple, or Google), or cyberattacks.

15. Dispute Resolution

15.1 Informal Resolution First

Before filing any formal claim, you agree to contact us at support@chaosholdempoker.com and give us 30 days to resolve the dispute informally.

15.2 Binding Arbitration

If the dispute is not resolved informally, you and Gold Dog Games LLC agree to resolve it through final and binding arbitration rather than in court, except as provided in Section 15.3. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at www.adr.org.

• Arbitration will take place in Texas, United States, or virtually
• The arbitrator's decision will be final and binding
• Each party is responsible for their own attorneys' fees and costs, except: if a claim is determined by the arbitrator to be frivolous or brought in bad faith, the claimant shall reimburse the other party's reasonable attorneys' fees and arbitration costs

15.3 Exceptions to Arbitration

Either party may bring a claim in small claims court in lieu of arbitration, provided the claim qualifies under that court's jurisdiction.

15.4 No Class Actions

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

All claims must be brought in your individual capacity. Claims of multiple users may not be consolidated or joined in a single proceeding without our written consent.

15.5 Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Nothing in this section limits any rights you may have under the mandatory consumer protection laws of your country of residence that cannot be waived by contract.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top and notify you via an in-app notice. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the App.

17. Miscellaneous

• Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gold Dog Games LLC regarding the App.
• Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver — Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
• Assignment — You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
